PRIVACY POLICY

This is the Privacy Policy of Patient Doctor Technologies, Inc. (“PDT”).  

What is the purpose of this Privacy Policy?

This Privacy Policy describes the collection, storage, and dissemination practices of PDT with respect to the health and other personal information that we obtain from you either through our Doctella application (the “App”) or through this website, https://www.doctella.com, and all associated web pages (collectively, the “Site”). The App and the Site, including all services offered via the App and/or the Site, are sometimes referred to collectively in this Privacy Policy as the “Service.”

We may receive health or other personal information about you from other parties, such as health care providers who use the Service or other services we may provide.  We may also, as a service to those other parties, maintain information about you that you have shared with them through the Service.  Our practices with respect to the information we receive from other parties, or that we maintain on their behalf through the Service or other services we may provide, are subject to our agreements with those other users and are not subject to this Privacy Policy.  For example, if we receive information about you from, or maintain such information for, a user that is a health care provider or other HIPAA covered entity for whom we act as a business associate, our obligations with respect to the privacy and security of that information will be governed by our business associate agreement with that other user, and not by this Privacy Policy.

Please note that by using or accessing any of the Service, you are accepting the practices described in this Privacy Policy. If you do not agree to all of the terms of this Privacy Policy, please do not use the App, the Site, or any other element of the Service. Please read this Privacy Policy carefully.

What information do we collect from users of the Service, and how do we use it?

The following describes the types of personal or other information we may collect about you through the Service, and how we use and maintain that information:

Registration. Before using the App or other elements of the Service for the first time, you may be asked to register with PDT and to provide us certain personal information, such as your first and last name, email address, mailing address or other contact information and personal details. If requested by or on behalf of PDT, this information is requested for identification purposes, to communicate with you regarding your use of the Service or the terms governing the Service, and to facilitate the functioning of the Service or related PDT technology. We may also use this information to notify you of new features on the Service, or to request that you provide feedback to PDT about the Service. We may keep this information indefinitely.

Health and Medical Data. When you use the Service, or when another user uses the Service to [communicate with you about your health care]  or other matters, any health or other personal information that is input or otherwise posted to the Service, including without limitation information regarding your past or present health conditions, health care services, medications, dosages, and contemplated medical or other procedures, will be obtained by PDT.  When you or another user enters information into the Service that is protected by password set by you, that information will be recorded in an encrypted form. We will use this information to provide the Service to you. We may use any information that you do not protect with a password for targeted advertising and other marketing purposes. In some cases, but not all, we may be required by law to obtain your authorization before using your information for marketing purposes.  We may keep this information indefinitely.

Usage Data. When you use the Service, we will collect certain usage data generated through your use of the Service. We may use this information as part of our providing the Service to you, and to improve the experience of users with the Service. We may also use such information for targeted advertising and other marketing purposes, or to request that you provide feedback about the Service. In some cases, but not all, we may be required by law to obtain your authorization before using your information for marketing purposes.  We may keep this information indefinitely.

Location Information. When you use the Service, we may collect information regarding your location from the GPS functionality in your Apple device with the App. We may use this location information as part of our providing the Service to you, and to improve the experience of users with the Service. We may also use such information for targeted advertising and other marketing purposes, or to request that you provide feedback about the Service. In some cases, but not all, we may be required by law to obtain your authorization before using your information for marketing purposes.  We may keep this information indefinitely.  

Online Inquiries. When you submit an inquiry via the Site, we ask for your first and last name, email address, mailing address and certain other information. We request this information for identification purposes, and to communicate with you regarding your inquiry. We may keep this information indefinitely.

Correspondence. If you correspond with PDT through the Service (or via email), we may gather in a file specific to you the information that you submit. We may keep this information indefinitely.

URL and IP addresses. Like many other providers of online services, we collect information about users of the Service. This information helps us to design the Service to better suit our users’ needs. For example, the Site will track the URL that you visited before you came to the Site, the URL to which you next go and your Internet Protocol (IP) address. We use your IP address to help diagnose problems with our server and to administer the Site and other elements of the Service. Your IP address also is used to help identify you and to gather broad demographic information. We may keep this information indefinitely.

Online Information Gathering Tools. Like most online services, we may also use cookies, web beacons, and other online information gathering tools in connection with the Service. These tools are intended to make using the Site and other elements of the Service easier by, among other things, saving your preferences for you. We may also use cookies to deliver content tailored to your interests. If your browser is set to reject cookies, or if your browser notifies you that you are about to receive a cookie and you reject it, then your use of the Service may not be as efficient or as enjoyable as it would be if the cookie were enabled. We only use information collected with online information gathering tools like cookies on an aggregated basis without the use of any information that personally identifies you.

Third-Party Integrated Services. We may implement certain third-party advertising or other content on the Service, or integrate other third-party offerings into the Service, enabling such third parties to collect information about you through your use of the Service. Any information collected through such integrated technologies would be collected directly by these third parties for use by such third parties and other authorized parties, subject to the privacy practices and policies of such third parties.

To whom do we disclose information about you collected through the Service?

PDT may disclose the personal or other information collected about you through the Service either (i) when we have your permission or (ii) in any of the following situations without your permission:

In addition, if you use the Service outside of the United States, information that we collect about you through the Service will be transferred to servers inside the United States and maintained indefinitely, which may involve the transfer of information out of countries located in the European Economic Area. By using the Service, you consent to such transfer and processing of data about you.

What security measures do we employ for information about you collected through the Service?

To help protect the privacy of data collected through the Service, we employ security measures for certain data collected through the Service which are intended to be consistent with industry standard practices and applicable regulatory requirements. In addition, we take commercially reasonable steps to store certain data collected through the Service with the objective of protecting such data against unauthorized access. HOWEVER, PLEASE BE AWARE THAT - THE SERVICE IS OPERATED ON SOFTWARE, HARDWARE AND NETWORKS, ANY COMPONENT OF WHICH MAY, FROM TIME TO TIME, EXPERIENCE BREACHES OF SECURITY OR OTHER PROBLEMS BEYOND OUR CONTROL.  

Please also be aware that despite our best intentions and the guidelines outlined in this Privacy Policy, no data transmission over the Internet or via a Wi-Fi network, or any encryption method, can be guaranteed to be completely secure. You understand that it may be possible for third parties not under PDT’s control to intercept or access your health, medical or other personal information transmitted through the Service or private communications, including in the case of your contacting us by email or via a “contact us” or similar feature on the Site.  Accordingly, although PDT will take reasonable steps to protect the security and integrity of all information you provide through the Service, due to the inherent nature of the Internet as an open global communications vehicle, PDT cannot guarantee that any such information, whether during transmission through the Internet or while stored on our systems or otherwise in our care, will be absolutely safe from intrusion by others who do not have your authorization. Any such transmission or sharing of that information is done at your own risk.

How can you correct or update information about you that is stored by PDT?

You may correct or update information collected about you through the Service by contacting us at the email or mailing address noted below. We will use commercially reasonable efforts to update our files as promptly as possible. However, we cannot retrieve or modify information for you if you have protected that information with a password you have set and do not make that password available to us. If you lose or forget your password and do not recover or reset that password through the Service, you information may effectively be lost.

We may retain original and updated information for reasons such as technical constraints, dispute resolution, compliance with laws, fraud prevention, troubleshooting and agreement enforcement. In addition, we are not responsible for updating or removing any information about you collected through the Service that is already disclosed to third parties who have been provided such information as permitted by this Privacy Policy.

At this time, PDT does not support “Do Not Track” preferences that may be available in your browser for letting websites know that you do not want them collecting certain kinds of information. Specifically, if you turn on the Do Not Track setting on your browser, the Site and other online elements of the Service are not currently capable of following whatever Do Not Track preferences you set. How does this Privacy Policy affect information we receive from or may provide to your health care provider?

If your doctor or other health care provider has engaged Doctella to perform a function, activity, or service through the Service or otherwise, then our practices and obligations with respect to the privacy and security the the information that we create, receive, maintain, or transmit on behalf of your health care provider will be governed by agreement with that provider, and not by this Privacy Policy.

What are the policies of linked websites and other third parties?

This Privacy Policy only addresses the use and disclosure of information collected through the Service by PDT. You should be aware that when you are using the Service, you may be directed to other websites that are beyond our control, and PDT is not responsible for the privacy practices of third parties or the content of linked websites. We would expect most, if not all, of these third parties will collect information about you when you use their offerings. However, PDT is not responsible for the privacy practices of third parties, regardless whether they are linked or otherwise connected to the Service. We encourage you to read the posted privacy policy whenever interacting with any third-party website, app, or other offering.

What is our policy on children users of the Service?

We do not knowingly collect or maintain personally identifiable information from persons under 13 years old, and no part of the Service is directed to persons under 13. IF YOU ARE UNDER 13 YEARS OF AGE, PLEASE DO NOT USE OR ACCESS THE SERVICE AT ANY TIME OR IN ANY MANNER. If you learn that your child under 13 has provided us with personal information without your consent, please contact us.

Will your employer have access to information that collected about you through the Service?

If you use the Service as a representative of a third party, such as your employer, that party may review and modify your personal information, ask us to delete your personal information, or request that we cease collecting your personal information. If such a third party asks us to delete your personal information or cease collecting your personal information, we may terminate your right to access the Service.

What are your California Privacy Rights?

From time to time, PDT may share information collected from you with third parties for their direct marketing purposes. Under California law, a California resident with whom we have an established relationship has the right to request certain information with respect to the types of personal information that PDT has shared with third parties for these purposes, and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. All requests for such information must be in writing and sent to PDT at the mailing address set forth below.

What law governs my use of the Service?

By using the Service, or otherwise providing information to PDT, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of California, without reference to the choice of law or conflicts of law principles thereof, and will be subject to the dispute resolution clause contained in the the terms of use applicable to the Site. You also agree to abide by any limitation on damages contained in the end user license agreement applicable to the App, the terms of use applicable to the Site, or any other agreement that we have with you.

What are the terms regarding any future changes to this Privacy Policy?

PDT reserves the right to update or modify this Privacy Policy from time to time, with any such changes to be effective prospectively. Please visit this page periodically so that you will be apprised of any such changes. Your continued use of the Service after any modification to this Privacy Policy will constitute your acceptance of such modification.
